Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and ZZ Labs LLC ("ZZ Labs", "we", "us", or "our"), the operator of the InsightLens mobile application ("App") and the website at insightlens.dev ("Site"). By downloading, accessing, or using the App or Site, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility & Acceptance

You must be at least 13 years old to use the App, and at least 18 years old (or the age of majority in your jurisdiction) to purchase a subscription. By using the App you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.

2. Description of Service

InsightLens is a food label scanning app that uses artificial intelligence to extract ingredient lists from food product labels and compare them against a user-defined list of ingredients to avoid ("Red Flags"). The App is provided on a freemium basis — certain features require a Premium subscription.

3. Not Medical, Dietary, or Allergy Advice

InsightLens is an informational and convenience tool only. The App does not provide medical, dietary, allergy, nutritional, or health advice, and is not a medical device. Results must not be relied upon as a substitute for professional medical advice, diagnosis, or treatment. Always read the physical product label and consult a qualified healthcare provider regarding allergies, intolerances, dietary restrictions, or health conditions.

If you have a food allergy, intolerance, or any medical condition where consuming a particular ingredient could be harmful, do not rely on InsightLens. Always read the actual product packaging yourself. You assume all risk associated with relying on scan results.

4. Accuracy Disclaimer

The App relies on AI models and third-party services to read food labels. Accuracy may be affected by label quality, lighting, image clarity, label format, ingredient naming, packaging changes, and other factors. Ingredients may be missed, misread, incorrectly matched, or incorrectly cleared. We do not warrant that ingredient extraction or Red Flag matching is complete, accurate, current, or error-free.

5. Your Responsibilities

You are solely responsible for your own decisions and actions, including:

Verifying scan results against the actual physical product label before purchasing or consuming any product;
Any decision to purchase, not purchase, consume, or not consume any food product. Such decisions are yours alone, and ZZ Labs is not a party to and bears no responsibility for any transaction between you and any retailer or manufacturer;
Maintaining the security of your device and any credentials used with the App.

6. Premium Subscriptions

InsightLens Premium is available as a monthly or annual auto-renewing subscription. Subscriptions are sold and managed through the Apple App Store (iOS) or Google Play (Android), not directly by ZZ Labs.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period;
You can manage and cancel subscriptions in your device's App Store or Google Play account settings;
Payments, billing, and refunds are handled by Apple or Google and are subject to their policies. ZZ Labs does not process payments and cannot issue refunds directly;
Free tier limits (scan quota and Red Flag count) apply to non-Premium users and may change over time.

7. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms;
Reverse-engineer, decompile, or attempt to extract the source code of the App;
Use automated tools, scrapers, or scripts to access the App or make excessive requests to our servers;
Attempt to circumvent subscription, rate limiting, or other access mechanisms;
Interfere with or disrupt the integrity or performance of the App or its infrastructure.

8. Intellectual Property

All content, trademarks, and code in the App and on the Site are owned by ZZ Labs or its licensors. You may not reproduce or redistribute any part of the App or Site without written permission.

9. Disclaimer of Warranties

The App and Site are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, ZZ Labs disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free, or that results will be accurate or reliable.

10. Limitation of Liability

To the maximum extent permitted by law, ZZ Labs and its owners, members, and operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury or health consequences, arising out of or relating to your use of or inability to use the App, even if advised of the possibility of such damages. In no event will ZZ Labs' total aggregate liability for all claims relating to the App exceed the greater of (a) the total amount you paid to ZZ Labs (via Apple or Google) in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars (US$50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless ZZ Labs and its owners, members, and operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party or any law.

12. Third-Party Services

The App relies on third-party services including Apple, Google, Google's Gemini AI, and cloud infrastructure providers. We are not responsible for the acts, omissions, availability, or policies of third parties. Your use of Apple and Google services is governed by their respective terms.

13. Service Availability

We may modify, suspend, or discontinue the App or any feature at any time, with or without notice. We do not guarantee that the App will always be available or that scans can always be completed.

14. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes take effect constitutes acceptance. We will update the "Last updated" date above when changes are made.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. You agree that any dispute will be resolved exclusively in the state or federal courts located in Washington, and you consent to their jurisdiction, except where prohibited by applicable law.

16. Miscellaneous

These Terms constitute the entire agreement between you and ZZ Labs regarding the App and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
